Activity-Specific Participant Terms & Conditions: Guided Hill Walking Activities

1. Introduction
These Activity-Specific Participant Terms & Conditions apply to all guided hill walking activities delivered by Resilience & Rise Ltd. These Terms are in addition to the Resilience & Rise Ltd General Booking Terms & Conditions. By participating in a guided hill walking activity, you agree to comply with both documents Where any inconsistency exists between these Activity-Specific Terms and the General Booking Terms & Conditions, these Activity-Specific Terms shall take precedence.
2. Scope
These Terms apply to all guided walking activities undertaken within the scope of a Mountain Training UK & Ireland Summer Mountain Leader qualification.
Activities may include, but are not limited to:
Guided hill walking
Upland walking
Mountain walking
Leadership and resilience activities undertaken on foot
Navigation activities
Environmental interpretation
Corporate development and engagement activities undertaken in hill and mountain environments
Activities may take place throughout the United Kingdom in terrain appropriate to the qualification and experience of the appointed leader. These Terms do not apply to activities involving technical climbing, winter mountaineering or other specialist activities unless expressly stated.
3. Nature of Hill Walking
Hill walking takes place in natural environments where hazards cannot be completely eliminated. Participants acknowledge that activities will be tailored to the event objectives, but may involve:
uneven, rocky or unstable ground;
steep ascents and descents;
wet, boggy or slippery terrain;
river or stream crossings;
exposure to changing weather conditions;
prolonged periods away from roads or buildings;
limited mobile phone coverage; and
delayed access to emergency services.
Resilience & Rise will take reasonable steps to identify, assess and manage foreseeable risks but cannot eliminate all hazards associated with outdoor environments.
4. Weather Conditions
Mountain weather is inherently unpredictable. Activities may proceed in rain, wind, heat, cold, mist or other typical mountain weather where it is safe to
do so. For safety reasons, Resilience & Rise may:
alter the planned route;
change the venue;
shorten the activity;
delay the start;
cancel the activity; or
terminate the activity early.
The event leader's decision regarding safety is final.
5. Participant Responsibilities
Participants agree to:
take reasonable care of their own health and safety;
behave responsibly towards other participants;
follow all reasonable instructions given by the event leader;
remain with the group unless authorised otherwise;
immediately inform the leader of any illness, injury or equipment issue;
respect the countryside, wildlife and other users of the outdoors; and
comply with applicable laws and the Scottish Outdoor Access Code or equivalent access legislation elsewhere in the UK.
Participants whose behaviour compromises safety may be withdrawn from the activity.
6. Fitness and Medical Information
Participants are responsible for ensuring that they are physically capable of completing the activity.
Participants must disclose any medical condition, injury, allergy, disability or medication that may reasonably affect:
their own safety;
the safety of others; or
the safe delivery of the activity.
Information must be accurate and updated if circumstances change before the activity. Where, in the reasonable opinion of the event leader, participation presents an unacceptable safety risk, participation may be refused or ended.
7. Required Equipment
Participants are responsible for arriving suitably equipped.
Unless advised otherwise, participants should normally bring:
waterproof jacket;
waterproof trousers;
appropriate walking boots or walking shoes with suitable tread;
clothing suitable for the forecast conditions;
sufficient food and drinking water;
any required personal medication;
any equipment specified in the joining instructions.
Resilience & Rise reserves the right to refuse participation where unsuitable equipment would create an unacceptable safety risk.
8. Group Management
For the safety and enjoyment of all participants:
the group will normally remain together;
participants must not leave the group without informing the leader;
reasonable instructions regarding pace, route, rest stops and safety must be followed;
participants should promptly report any concerns affecting their ability to continue.
The event leader's decisions relating to safety and group management are final.
9. Environmental Responsibility
Participants are expected to help protect the environments in which activities take place.
Participants agree to:
minimise environmental impact;
avoid unnecessary disturbance to wildlife;
leave gates as found;
take litter home;
follow recognised Leave No Trace principles where appropriate.
10. Dogs
Dogs are only permitted where expressly authorised by Resilience & Rise before the activity.
Owners remain fully responsible for the behaviour, welfare and control of their dogs throughout the activity.
Resilience & Rise reserves the right to refuse participation where a dog presents a safety or welfare concern.
11. Emergency Situations
Participants agree that, in an emergency:
the event leader may share relevant personal or medical information with emergency services where necessary to protect life or health;
participants will follow emergency instructions given by the event leader.
12. Photography
Photography during activities must not compromise safety or unreasonably interfere with other participants.
Where Resilience & Rise takes photographs for promotional purposes, identifiable images will only be used with the participant's consent.
13. Inherent Risks
Participants acknowledge that hill walking involves inherent risks which cannot be completely eliminated despite competent leadership, appropriate planning and reasonable risk management.
These risks include, but are not limited to:
slips, trips and falls;
natural hazards;
rapidly changing weather;
fatigue;
uneven terrain; and
delayed emergency response.
Participants accept these inherent risks as part of taking part in hill walking activities.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded.
14. Leader Authority
The appointed event leader has overall responsibility for the safe management of the activity.
For reasons of safety, the leader may:
alter the planned itinerary;
modify the activity;
refuse participation;
withdraw a participant from the activity; or
terminate the activity.
These decisions will always be made in the interests of participant safety.
15. Governing Law
These Terms are governed by the laws of Scotland.
Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
