General Booking Terms & Conditions

1. Introduction

These General Booking Terms & Conditions ("Terms") apply to all products, services, events and activities provided by Resilience & Rise Ltd ("Resilience & Rise", "we", "our" or "us"). By making a booking, you confirm that you have read and agree to these Terms. Certain activities may also be subject to Activity-Specific Participant Terms, which form part of the contract between you and Resilience & Rise. Where there is any inconsistency, the Activity-Specific Participant Terms shall take precedence for that activity.

3. Definitions

For the purposes of these Terms:

  • Booking means a confirmed reservation for any service, event or activity.

  • Client means the individual or organisation making the booking.

  • Participant means any individual attending or taking part in an event or activity.

  • Activity means any service, event, workshop, walk, programme or experience delivered by

Resilience & Rise.

4. Bookings

A booking is confirmed only when:

  • we have accepted your booking;

  • any required deposit or payment has been received;

  • and any required participant information has been submitted.

We reserve the right to refuse any booking at our discretion.

5. Corporate Bookings

Where an organisation books on behalf of participants, the organisation confirms that it has authority to make the booking.

The organisation is responsible for ensuring that participants:

  • receive relevant joining information;

  • complete any required participant forms; and

  • comply with any Activity-Specific Participant Terms.

6. Prices and Payment

All prices are quoted in Pounds Sterling (£).

Unless otherwise agreed in writing:

  • invoices are payable within 30 days of the invoice date;

  • deposits are non-refundable unless stated otherwise;

  • full payment must be received before the activity takes place.

Late payment may result in cancellation of the booking or postponement of services.

Where applicable, VAT will be charged at the relevant rate.

7. Changes to Bookings

Requests to amend a booking will be considered where reasonably practicable but cannot be guaranteed.

Additional charges may apply where changes increase costs or require significant re-planning.

8. Cancellation by the Client

Unless otherwise agreed in writing:

  • more than 28 days before the activity: full refund of monies paid, less any non-refundable deposit;

  • 14–28 days before the activity: 50% refund;

  • less than 14 days before the activity: no refund.

Where appropriate, bookings may be transferred to another participant or rescheduled at our discretion.

9. Cancellation by Resilience & Rise

We reserve the right to postpone, modify or cancel any booking where necessary due to circumstances including:

  • severe weather;

  • instructor/guide illness;

  • safety concerns;

  • insufficient participant numbers;

  • venue issues;

  • circumstances beyond our reasonable control.

Where we cancel an activity before it begins, clients will be offered either:

  • an alternative date; or

  • a full refund of payments received.

Our liability is limited to the amount paid for the booking unless otherwise required by law.

10. Participant Information

Participants may be required to provide personal information relevant to the safe and effective delivery of an activity.

Where requested, information must be accurate and complete. Failure to provide required information may prevent participation.

11. Health, Safety and Welfare

Participants agree to comply with all reasonable instructions given by Resilience & Rise representatives during any activity.

Where participation presents an unacceptable safety risk, we reserve the right to refuse or end participation.

12. Photography and Media

Photographs, video or other media may be taken during activities.

We will only use identifiable images for marketing or promotional purposes with the individual's consent.

13. Intellectual Property

Unless otherwise agreed in writing, all materials, presentations, workbooks, digital resources and other content supplied by Resilience & Rise remain our intellectual property.

They may not be copied, reproduced, distributed or used for commercial purposes without our prior written permission.

14. Confidentiality

We respect the confidentiality of discussions that take place during coaching, leadership development and facilitated sessions. Participants are expected to respect the privacy of fellow participants. Where corporate clients engage us to facilitate discussions, commercially sensitive information shared during activities will be treated as confidential unless disclosure is required by law.

15. Data Protection

We process personal information in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018 and our Privacy Policy.

Our Privacy Policy explains how personal information is collected, used, stored and protected.

16. Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • any liability that cannot lawfully be excluded.

Subject to the above, our liability for any claim arising from a booking shall not exceed the amount paid for the relevant booking, except where otherwise required by law.

17. Force Majeure

Resilience & Rise shall not be liable for any failure or delay in performing its obligations where this results

from circumstances beyond our reasonable control, including but not limited to:

  • severe weather;

  • flooding;

  • wildfire;

  • epidemic or pandemic;

  • industrial action;

  • transport disruption;

  • government restrictions;

  • acts of terrorism; or

  • failure of utilities or communications.

18. Complaints

If you are dissatisfied with any aspect of our services, please notify us as soon as reasonably practicable.

Formal complaints should be submitted in writing within 14 days of the relevant activity.

We aim to acknowledge complaints within five working days and provide a substantive response within

twenty working days.

19. Governing Law

These Terms are governed by the laws of Scotland.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
